Mengusut Tuntas Kejahatan Prostitusi Online dalam Penegakan Hukum Terhadap Pekerja dan Pengguna Jasa Seks Komersial

This research was conducted to obtain an overview related to law enforcement against online prostitution crimes and what are the inhibiting factors for law enforcement. The author tries to answer legal problems from the normative side based on both the rule of law in the law and norms. The legal materials that the author uses are secondary legal materials and primary legal materials. The results of the discussion are that in terms of law enforcement online prostitution at this time can only ensnare pimps or service providers only commercial sex workers and even then only article 296 of the Criminal Code is relevant while customers or commercial sex workers are only used as witnesses, this is very contradictory to the facts on the ground. where the tendency of both pimps, sex workers and customers alike benefit, but because there is no specific phrase in either the law or the Criminal Code which states that sex workers and their customers are criminal acts, this often results in customers and sex workers being used as witnesses instead of a crime The factors that hinder law enforcement against online prostitution as a criminal act of prostitution consist of regulatory factors, law enforcement factors, facilities and law enforcement factors, community factors and cultural factors. Lack of control mechanisms from the judicial component in every case examination process, law enforcers who lack cyber units in law enforcement institutions.
Penelitian ini dilakukan untuk memperoleh gambaran berkaitan dengan penegakan hukum terhadap kejahatan prostiusi online dan apa yang menjadi faktor penghambat terhadap penegakan hukum tersebut. Penulis mencoba menjawab permasalahan hukum dari sisi normatif berdasarkan baik aturan hukum dalam perundang-undangan maupun norma-norma. Bahan hukum yang penulis pergunakan yaitu bahan hukum sekunder dan bahan hukum primer. Hasil pembahasan yakni Dalam hal penegakan hukum tindak pidana prostitusi online pada saat ini hanya bisa menjerat mucikari nya saja atau penyedia layanan pekerja seks komersialnya itupun hanya pasal 296 KUHP yang relevan adapun pelanggan atau pekerja seks komersialnya hanya dijadikan sebagai saksi hal ini sangat kontradiktif dengan fakta dilapangan dimana kecenderungan baik mucikari, psk dan pelanggan sama-sama mendapatkan keuntungan, akan tetapi karena tidak ada nya frasa yang spesifik baik dalam undang-undang maupun KUHP yang menyebutkan psk dan pelanggannya merupakan tindak kejahatan maka terjadi kekosongan yang menyebabkan seringkali pelanggan dan psk nya hanya dijadikan saksi bukan pelaku tindak kejahatan Faktor-faktor yang menjadi penghambat penegakan hukum terhadap prostitusi online sebagai tindak pidana prostitusi terdiri dari faktor Aturan hukum yang mengatur, faktor penegak hukum, faktor sarana dan fasilitas dalam penegakan hukum, faktor masyarakat dan faktor budaya. Kurangnya mekanisme kontrol dari komponen peradilan pidana dalam setiap proses pemeriksaan perkara, penegak hukum yang kurangnya unit cyber dalam institusi penegak hukum.
